Terms & Conditions (English) In these terms and Conditions the word “participant” means Entrants and participants in the Safari International Marathon. “The Event” means Half Marathon and Fun Run. Safari International Marathon acknowledges that although all precautions have been taken by the organizing body to ensure the safety of all participants, there may be dangers inherent in participation in the Event and activities related thereto. Participant voluntarily assume the risks of attendance at and participation in the Event and hereby waive all claims of whatsoever nature and howsoever arising in relation to the Event or otherwise against any parties, including but not limited to the organizing body, the sponsors, the advertisers, any local authority and /or the directors, employees, suppliers and assistants of these parties, including any individual, official or agent. Participants hereby irrevocably indemnify and hold harmless the Parties against any liability and claims of any nature whatsoever and howsoever arising (whether directly or indirectly caused and whether arising from negligence, albeit gross, or from the participation or involvement in or passage to or from the Event or otherwise) including but not limited to liability for delay, inconvenience, accident, death, injury, illness to their person, or loss or damage to property or costs and expenses sustained, incurred or put to by Participants and/or by any minor children under the care or control of participants. Parents or guardians authorizing a minor’s participation in the Event, which shall prima facie be evidenced by their signature on this entry form, hereby consent to such minor being bound to the aforegoing and further indemnify the Parties to the extent, if any, to which such minor is not capable of waving his/her rights as stipulated above. I confirm that I am competent and/ or authorized to sign this registration form and agree to the terms and conditions hereto. I further give permission for the free use of my name, voice or picture [still or moving] to be used in any broadcast, telecast, advertising, promotion or any other form of advertising of this and future events. Vigezo na Masharti (Kiswahili) Kwenye hivi vigezo na masharti neno “Mshiriki” linamaanisha mtu aliengia na kushiriki mbio za Safari International. “Tukio” luinaanisha Mbio Fupi (Half Marathon) na mbio za kijifurahisha (Fun Run). Safari International Marathyon wanakubali kuwa wamechukua tahadhari ya kuhakikisha usalama wa Washiriki katika mashindano hayo, bado kuna uwezekano wa ajali na hatari kutokea. Washiriki kwa ridhaa yao wenyewe wameafiki kushiriki katika Mashindano haya wakijua fika uwezekano wa ajali na kuhatarisha maisha yao, na kwa ajili hiyo wanatoa kinga ya kutokudai fidia au madai ya aina yeyote kutokana na Mashindano haya au kwa namna yeyote ile dhidi ya mtu yeyote, pamoja na pasipo ukomo kwa Waandaaji na Wafadhili wa mashindano haya, Watangazaji, Serikali ya Mitaa au Mamlaka yeyote pamoja na/au Wakurugenzi, Wafanyakazi, Wagavi na wasaidizi wao wote waliotajwa hapa, pamoja na mtu binafsi, Afisa au Wakala (“Wahusika”). Washiriki wanaahidi kutodai fidia au madai ya aina yeyote ile (iwe imesababishwa moja kwa moja au la, iwe imesababishwa kwa uzembe au la, au kwa kushiriki au kuhusika katika kupita njia au kwa Tukio au kwa namna nyingine) ikijumuisha na pasipo kuhusisha ucheleweshaji, usumbufu au aidha, ajali, kifo, kuumia, ugonjwa, kwa watu wao, au hasara au uharibifu kwenye mali au gharama na matumizi yaliyofanyika, kufanyika au kuwekwa na Washiriki na/au mtoto yeyote yule chini ya uangalizi au msimamizi wa Washiriki. Mzazi au Mlezi/Mwangalizi wa watoto atakaemruhusu mtoto/watoto wao kushiriki katika tukio itampasa kuweka saini katika fomu hii, ikiwa ni ushahidi wao wa wazi wa kuridhia na kuafiki masharti yote ya kushiriki katika mashindano, na aidha kutofidia kwa Wahusika kwa kiwango, iwapo kipo, ambacho mtoto hataweza kuondoa haki na madai yake kama yalivyoelezwa hapo juu. Mimi nitathibitisha ya kuwa nina uwezo na Mamlaka na/au kuidhinisha kwa fomu hii na ninakubaliana na masharti na matakwa yaliyoelezwa humu. Aidha ninatoa ruhusa na ridhaa ya kutumia pasipo malipo ya aina yeyote, jina langu, sauti, picha yangu (iliyosimama, kukaa, au inayotembea/kukimbia) itumike katika matangazo, mawasiliano ya aina yeyote yale, promosheni au aina nyingine na yeyote ile ya matangazo sasa na kwa matukio ya baadae.
